Acceptance of Terms

By downloading, installing, or using TallyFit (“the app”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the app.

Description of Service

TallyFit is a workout tracking application that allows users to:

• Log exercises and repetitions
• Create and manage workout routines
• Track workout history
• Access premium features through subscription

User Accounts and Data

• You are responsible for maintaining the security of your device
• All workout data is stored locally on your device
• We are not responsible for data loss due to device failure, app deletion, or other causes
• We recommend backing up your device regularly

Subscription Terms

Free Version

• Limited to 1 active workout at a time
• Limited to 4 exercises per routine
• No advertisements

Free with Ads

• Unlimited active workouts
• Unlimited exercises per routine
• Advertisements displayed within the app

Premium Subscription

• Unlimited active workouts and exercises
• No advertisements
• Access to all premium features
• Subscription automatically renews unless cancelled
• Pricing displayed in the app at time of purchase

Auto-Renewable Subscription Details

• Payment will be charged to your Apple ID account at confirmation of purchase
• The subscription automatically renews unless auto-renewal is turned off at least 24 hours before the end of the current billing period
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price
• You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase
• Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription

Advertising

Users on the “Free with Ads” plan will see advertisements served by Google AdMob. By using the Free with Ads plan, you consent to the display of advertisements and the collection of data necessary to serve those ads, as described in our Privacy Policy.

Acceptable Use

You agree NOT to:

• Use the app for any illegal purpose
• Attempt to reverse engineer or hack the app
• Violate any applicable laws or regulations
• Use the app in a way that could damage, disable, or impair the service

Medical Disclaimer

IMPORTANT: TallyFit is a fitness tracking tool only. It is NOT a substitute for professional medical advice, diagnosis, or treatment.

• Always consult with a qualified healthcare provider before starting any exercise program
• We are not responsible for any injuries or health issues that may result from using the app
• Use the app at your own risk

Intellectual Property

• TallyFit and its original content, features, and functionality are owned by us
• The app is protected by copyright, trademark, and other laws
• You may not copy, modify, distribute, or reverse engineer any part of the app

Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement

Limitation of Liability

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from:

• Your use or inability to use the app
• Any bugs, viruses, or errors in the app
• Data loss
• Personal injury related to exercise

Changes to Terms

We reserve the right to modify these terms at any time. Continued use of the app after changes constitutes acceptance of the new terms.

Termination

We may terminate or suspend your access to the app immediately, without prior notice, for any reason, including breach of these Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales.
